The Australian Financial Complaints Authority (AFCA) is inviting feedback from stakeholders on two draft Approach documents that focus on key areas within superannuation complaints.

The documents under consultation are: 

  • AFCA’s Approach to sections 29(6) and 29(7) of the Insurance Contracts Act 1984 (superannuation) (new). This Approach addresses the application of sections 29(6) and 29(7) of the Insurance Contracts Act 1984, and 
  • AFCA’s Approach to delayed insurance claims in superannuation (amended). This amended Approach includes minor clarifications without substantive changes to the existing Approach. 

The consultation period runs from Monday, 9 September 2024, to Monday, 30 September 2024. Stakeholders are encouraged to review the documents and submit their feedback by the closing date. AFCA values the insights of all stakeholders and will consider all submissions after the consultation period concludes. 

These draft documents are designed to enhance clarity and transparency in AFCA’s complaint handling processes, ensuring consistent outcomes for all parties involved in superannuation disputes. They outline how AFCA applies legal principles, industry codes, and regulatory guidance when investigating these complaints.
